DeVerse Explorer — Terms of Service

Thank you for using DeVerse Explorer (DE) to browse project information.

 

To use the DeVerse Explorer (hereinafter referred to as "DE") and its services, you should read and comply with the DeVerse Explorer Licensing and Service Agreement (hereinafter referred to as "this agreement"). Please read carefully and fully understand all terms and conditions, and choose to accept or reject them.

 

Unless you have read and accepted all the terms and conditions of this agreement, you have no right to browse, download the DE and its related services. Your application for authorization code, login, browse, access to project information is considered as you have read and agree to this agreement.

I.        Scope of the Agreement

This agreement is between you and DeZerlin Media regarding your browsing and downloading of projects stored in the system.

 

II.     About the Service

1.      Contents of the Service

The contents of the service are provided to specific clients of DeZerlin, a cross-platform project information browsing tool (hereinafter referred to as "KOH").

2.      The Form of the Service

You need an authorization code to use the services, which is a personal, non-transferable and non-exclusive permission provided by DeZerlin.

3.      All other rights which are not expressly granted by this agreement and all other terms of this agreement shall be retained by DeZerlin, and you shall have to obtain the written permission of DeZerlin in the exercise of these rights. If DeZerlin doesn't exercise any of these rights stated previously, which doesn't constitute a waiver of that right.

 

III.   To Obtain the Authorization Code

You can contact DeZerlin's producers, executive producers and marketing team, to exchange cooperation intention and obtain authorization code.

 

IV.  Considerations

You shall understand and agree that, in order to provide an effective service to you, the DE will utilize resources such as the processor and bandwidth of your terminal device. The cost of data traffic might be generated during usage. The users shall get related cost information from the operator, and be responsible for related cost on their own.

 

V.     Specifications

Unless permitted by law or DeZerlin's written permission, you shall not engage in the following acts in the process of using the system:

1.      To delete information about copyright obtained from DE;

2.      To reverse engineering, assembly and compilation or try to figure out the source code of the system in other methods;

3.      To use, copy, modify, link, reprint, publish, announce, publish, mirror copyrighted contents owned by DeZerlin;

4.      To copy, modify, add, delete, hook any data released to any terminal during running the DE, interactive data between clients and server while running the software, or system data necessary for running the system; including but not limited to the use of plug-in, tag-on or third party tool/service to access the system and related systems;

5.      To modify or forge the instructions or data while running DE, to add, delete and change software functions or running effect, or to run softwares and methods for the above purposes or market to the public, whether or not these behaviors are for commercial purposes;

6.      To login or use the DE and its services through third party softwares, plug-ins, add-ons or systems not developed by DeZerlin, or to create, publish and distribute the tools above

7.      To act on one's own or authorize others, third party softwares to disturb the system, its components, modules and data

8.      Any other behavior not authorized explicitly by DeZerlin

9.      You understand and agree that, based on the considerations for the safety of the DE, DeZerlin shall have the right to select whom to provide service for, to decide the function set up and its access, data interface and whom to disclose data to as well as the scope. Under the following circumstances , including but not limited to, violations of laws or provisions of this agreement, or security risks.

 

VI.  Breach of Contract

Under the condition that the visitor violates the regulations of this agreement discovered by DeZerlin, DeZerlin has the right to block the access of the visitor without notice. You understand and agree that, DeZerlin has the right to punish behaviors against laws or regulations of this agreement, to take appropriate legal actions against any visitor for violation of laws and these terms, to save information and report to relevant departments according to laws and regulations. The visitor shall be solely responsible for any legal responsibility arising therefrom.

 

VII.            Declaration of Intellectual Property

1.      DeZerlin is the intellectual property holder of the system. All copyrights, trademarks, patents, business secrets and other intellectual property rights of the system, as well as all information related to the current system (including but not limited to text, image, audio, video, graphic, layout, framework and relevant data and electronic documents etc.) are protected by the laws and regulations of the People's Republic of China and their correspondent international laws. DeZerlin retains the intellectual property rights stated above, but the rights of relevant right holders protected by laws are excluded.

2.      Without written consent by DeZerlin or relevant right holders, you shall not implement, utilize or transfer any of the above intellectual property  rights to any third party for commercial or non-commercial purposes.

 

VIII.          Third-Party Software and Technology

1.    This system may use third-party software or technology (including open +source codes  and public domain codes that this system might use), which has been legally authorized.

2.     If the system utilizes third party software of technology, DeZerlin will be in accordance with relevant laws and regulations; the relevant agreements or other documents may be packed within the appendix of the agreement, or specific document folder of the install pack, or exhibited through open source software page; they may also be explained through "Software License", "Authorization Agreement", "Open Source Code Permission" or others.

The forms described above to display relevant agreements, other documents and web pages, all of which are integral parts of this agreement, with equal legal effect. You shall comply with these requirements. If you don't comply, the third party or government agencies may issue civil lawsuit against you, demand fines or take on other sanction measures, or require DeZerlin to assist. You shall be responsible for your own liability.

 

IX.  Others

1.    By using this system, you've read and agreed to the regulations of this agreement. DeZerlin has the right to amend the terms of this agreement when necessary. You can refer to the terms in the latest version of the agreement. After the amendment, if you continue using this system, it means you've accepted the revised agreement. If you don't accept the revised agreement, you shall stop using this system.

2.    This agreement is signed in the LaoShan District of Qingdao, Shandong Province, People's Republic of China.

3.    The establishment, implementation, performance, interpretation and dispute resolution of this agreement shall apply to the laws of the mainland of the People's Republic of China (excluding Conflicts Law).

4.    If there is any dispute or controversy between you and DeZerlin, you should first resolve the dispute through amicable negotiation ; if negotiation fails, you agree to submit the dispute or controversy to the people's court which has jurisdiction over this agreement.

5.    For whatever reason, some of the terms of this agreement are invalid or can't be executed, the remaining ones shall remain in force and be binding upon both parties.
